1. Introduction
Andalucia is a private
sub-division with over 210 homes in the Hillsborough County South Shore
area. Andalucia amenities for residents include: 24-hour gated security,
lighted clay tennis courts, swimming pool, clubhouse, playground, 2
beaches, marina and a jetty.
We hope you will find
this document to be of assistance during your residence in Andalucia.
This document is intended to provide residents with the most common
information regarding rules and regulations that govern this community.
This document is intended to compliment the deed restrictions
(Covenants, Restrictions and Assessments) that govern Andalucia and does
not take the place of the deed restrictions. For detailed information,
please refer to your copy of the Declaration of Covenants, Restrictions
and Assessments for Andalucia.
Every resident shall
comply with the Covenants, Restrictions and Assessments and any rules
and regulations adopted by the Board of Directors. Failure to comply may
result in fines for non-compliance.
2. Andalucia Masters
Association Board of Directors (AMA)
The Board of Directors
meets the third Monday of each month. Date, time, and location is posted
at the community events sign located at the exit to Andalucia. Meetings
are open to all residents. The annual meeting is held the second Monday
of March each year unless the Board of Directors, upon notice to
members, designates a different date.
3. Andalucia
Architectural Review Committee (ARC)
The Architectural Review
Committee is a standing committee of the Andalucia Masters Association,
whose function is to oversee, review, approve/disapprove any plans,
changes and construction proposals within Andalucia. The Architectural
Review Committee meets the second Monday of each month. Date, time, and
location is posted at the community events sign located at the exit to
Andalucia.
4. ARC Submittal Policy
As home or property
owners, be advised that all plans must be submitted to the ARC for
approval prior to beginning construction. The ARC has adopted guidelines
and procedures to give guidance to lot owners in obtaining the necessary
approvals for building within Andalucia. Each home or lot owner should
thoroughly review the provisions of the Andalucia Covenants,
Restrictions and Assessments, AND Architectural Review Committee
Guidelines and Procedures prior to submitting plans for
consideration. Requests for new construction must be submitted in
writing to the ARC. The Application Form for New Construction can be

Gatehouse. Please note that Andalucia has certain requirements and fees
for new construction and additional requirements for additions,
modifications or changes to existing construction or landscaping.

5. Andalucia Yacht Club (AYC)
The Andalucia Yacht Club
is non-profit association that is responsible for the management of the
64-slip marina. The Board of Directors meet the fourth Monday of each
month. Date, time, and location is posted at the community events sign
located at the exit to Andalucia. Marina slips are either licensed or
sub-licensed to residents or property owners on an as available basis.
The Andalucia Yacht Club has its own set of By Laws that are available
upon request.
6. Assessments
All residents within
Andalucia are subject to annual assessments. Special assessments can be
established by the Board of Directors and collected by the Andalucia
Masters Association. Special Assessment's against residents for non-
compliance may also be imposed.
7. Clotheslines
Clotheslines are not
permitted unless they are completely hidden from view.
8. Clubhouse
The clubhouse is open for
use by all residents and their invited guests. No vehicle of any type
shall routinely park at the Clubhouse for purposes other than using this
community property. No overnight parking unless approved by the
President of the Board of Directors or his or her designee.
9. Clubhouse Rules
The complete list of the
Andalucia Master Association swimming pool, tennis court and beach rules
and regulations are posted on the bulletin board inside the clubhouse.
It is the resident's duty and responsibility to read and comply with the
rules and regulations as it applies to the use of these amenities.
9a. Swimming Pool
• There is no lifeguard
on duty.
• Proper swimming
attire must be worn while using the pool facilities. (Bathing suits
only).
• No running is allowed
on the pool deck.
• Children under the
age of 16 are not permitted in the swimming pool without adult
supervision.
• Use of the swimming
pool is for residents and their invited guests only. Residents must
accompany all guests.
• Residents and guests
must shower before entering the swimming pool.
• Swimming pool hours
are from 8:00am to 11:00pm.
• No glass of any kind
is permitted in the pool area.
• Pets are not
permitted in the pool area.
• Skates, roller
blades, skateboards, scooters, bicycles, and other similar types of
wheeled vehicles are not permitted.
• The Andalucia Masters
Association is not responsible for personal property, which is lost,
stolen or damaged.
•
Tables/chairs/recliners must be kept in the swimming pool area at all
times.
• Littering is not
permitted.
9b. Tennis Courts
• Use of the tennis
courts is for residents and their invited guests only. Residents must
accompany all guests.
• Children under the
age of 14 are not permitted in the tennis court area without adult
supervision.
• All players are to
sweep the courts and lines after play.
• Tennis or similar
type attire is required (No cutoffs allowed).
• Tennis court hours
are from 8:00am to 11:00pm .
• Turn light switch off
after play.
• If residents are in
line to play, there is a one hour 30 minute waiting limit for singles,
and 2 hours for doubles.

Association is not responsible for personal property, which is lost,
stolen or damaged.
• Littering is not
permitted.
9c. Beach
• There is no lifeguard
on duty.
• Use of the beach is
for residents and their invited guests only.
• Children under the
age of 16 are not permitted in the beach area without adult
supervision.
• No glass of any kind
is permitted in the beach area.
• Beach hours are from
8:00am to 11:00pm .
• Andalucia Masters
Association property such as tables and chairs, are not permitted on
the beach.
• The Andalucia Masters
Association is not responsible for personal property, which is lost,
stolen or damaged.
• Littering is not
permitted.
10. Clubhouse Rental
The Clubhouse can be
reserved/rented by any resident of Andalucia. Rental of the clubhouse
does not include the swimming pool, beach, and tennis courts. Therefore
any resident may use the swimming pool, beach and tennis courts during a
rental period.
• A security deposit is
required at time of reservation.
• A non-refundable fee
is collected for the use of the Clubhouse and electrical expenses.
• A clean up fee may be
collected. The resident is responsible for leaving the facility in the
same clean condition as before the rental. Any extra clean up or
damage repair that is required after a resident uses the facility,
will be completed by AMA management and the cost of the said clean up
or damage repair will be deducted from residents deposit and/or billed
to the resident.
• Residents must have a
deposit on file to guarantee a reservation.
• Residents can reserve
the Clubhouse 2 times per year. If the resident wishes to reserve the
clubhouse more than 2 times, they must obtain approval from the Board
of Directors.
• Reservation can be
made up to 12 months in advance of the date of the event.

11. Construction
All residents shall be
held responsible for the acts of their employees, contractors,
sub-contractors, suppliers and any other persons or parties involved in
the construction of a home site. The rules below are extracted from the
" Andalucia Contractor Rules and Regulations" document. This document
can be obtain from the Architectural Review Committee or the AMA's
Property Management company. Failure to comply with these rules and
regulations may result in fines for non-compliance.
• Stockpiling/dumping
debris on adjacent lots or on roads is prohibited.
• Ensure that the job
site is kept neat, clean and free of debris daily.
• Trash and discarded
materials must be removed daily or placed in an ARC approved
container.
• Assure that all
debris/materials are secured in the event of a hurricane.
• All contractors, subs
,and their employees must be properly insured. • All contractors,
subs, and their employees are confined to the resident's property.
• Contractor must
provide a copy of the Building Permit to the Architectural Review
Committee.
• Assure that only the
utilities provided on the immediate site will be used.
• The Gatehouse shall
be notified within 30 minutes if any utility lines are cut.
• Port o' lets are to
be placed in the optimum location on the lot that reduces the Port o'
let's visibility and odor to neighboring property owners.
• Port o' lets are to
be kept in clean & sanitary condition, door facing away from the
street and Port o' Lets tied or anchored down to prevent overturning
by wind or vandalism.
• Damage to roads,
curbs, lights, signs, sidewalks, or any AMA property or private
property shall be reported to the Gatehouse immediately.
• Grading or excavating
on the site will not disturb the adjacent property.
• Erosion fences (silt
fences) and barriers will be erected around the entire perimeter of
the property and maintained though out the project.
• Soil mounded on the
site for more than three days shall be covered.
• Covered soil may only
remain for two weeks.
• New fill must be
spread within three days and shall not be left uncovered over the
weekend.
• Must obey the
established twenty (20) mile per hour speed limit within Andalucia.
• Vehicles shall not be
left on the resident's property overnight.
• Construction
equipment may be left on the site, provided it's not parked on the
road.
• All contractors,
subs, suppliers, and their employees shall not bring pets into
Andalucia.
• Prohibiting the
consumption of alcoholic beverages, illegal drugs or other
intoxicants.
• All contractors,
subs, suppliers, and their employees obey the established working
hours in Andalucia, which are as follows:
• Monday through Saturday 7 AM to 7 PM
• No work is permitted on Sundays, Holidays or federally observed days
off for holidays.
• Prohibiting all signs
unless otherwise approved, in writing by the Architectural Review
Committee.
• Providing the
Andalucia Master Association a construction deposit check.
12. Enforcement and
Compliance
Every property owner and
resident shall comply with the Andalucia Masters Association Covenants,
Restrictions, and Assessments, and any rules and regulations adopted by
the Board of Directors. Failure to comply may result in fines for
non-compliance. Property owners and residents are responsible for
ensuring their guest and invitees comply with these restrictions and
rules. Failure to comply can result in fines, special assessments,
and/or prohibition against using any of the common facility amenities
(Club House, tennis courts, pool, beaches, and jetty).
13. Fences
All fence plans must
receive written approval from the Architectural Review Committee prior
to installation. All bushes or shrubbery must be placed on the outside
of the fence so as to hide the fence from the sight of the neighbor or
the street unless otherwise permitted by the Architectural Review
Committee.
14. Garage
Garages shall be used for
the purpose of parking vehicles, hobbies, and household goods. When
garages are not in use, the doors shall be kept closed.
14a. Garage Sales
Garage sales are not
permitted.
15. Gatehouse
There is one entrance and
exit for Andalucia. Residents gain access to the sub-division by use of
remote control "clickers", scan cards, or any new devise approved by the
Board of Directors. Visitors, contractors, sub-contractors, etc. must
stop at the Gatehouse and provide the attendant with information
regarding destination, tag #, and name.
Residents are required to
provide advance notice to the Gatehouse of any visitors, contractors,
sub-contractors, etc. that are expected. If a contractor, sub-contractor
or guest is not on the resident or property owners visitor list or the
resident or property owner has not called the gatehouse, the contractor,
sub-contractor or guest may be denied access. This practice helps to
ensures the safety and security of our community.

16. Jetty
Residents and guest may
fish from the jetty common area, however all trash and debris must be
removed. No Vehicle of any type shall routinely park at the Jetty for
purposes other than using this community property. No overnight parking
unless approved by the President of the Board of Directors or his or her
designee.
17. Landscaping
Landscaping of every
kind, including shrubs, trees, grass and plants shall be neatly trimmed,
cultivated, and maintained continuously by the resident.
• Lawns (grass) shall
be mowed, weeded, treated for pests and watered in a frequent manner
that is consistent with good property management. This means the lawn
must be devoid of insects, diseases, weeds, blotching, patches, etc,
that detract from the community aesthetics.
• Trimming of all plant
material in beds is required and includes all trees, including palms
and shrubs, as growth requires. This must be done on a regular basis
so as to maintain natural shaping of the plants and trees.
• It is the resident's
responsibility to trim and maintain their palm trees as well as those
that line the sidewalk/easement of their property.
• It is the resident's
responsibility to mow, weed, treat for pests and water the grass
located between the sidewalk/easement and the street.
• Landscaping changes
including removal and replacement, must receive written approval from
the Architectural Review Committee before implementation.
• No excavation or
clear cutting of trees shall be performed in violation of the
Covenants, Restrictions and Assessments for Andalucia or violation of
local or state regulations.
• All residents must
have 100% underground sprinkling coverage in operational condition.
• No resident may
plant, garden, erect or maintain fences, hedges, etc. upon the common
areas of Andalucia without approval by Architectural Review Committee.
18. Mailbox
Andalucia mailboxes must
be approved by the Architectural Review Committee that is of a type
consistent with the character of Andalucia. Residents are responsible
for maintaining their mailbox and replacing light bulbs and globes when
necessary.
Mailboxes, light bulbs
and globes can be purchased from the Andalucia Masters Association
directly. Residents should call the Gate House for instructions on how
to proceed with a mailbox, light bulb, or globe purchase. A Mailbox

19. Maintenance
Any structure or the
repair of any structure damaged by age, wear and tear, fire or
otherwise, shall be repaired within a reasonable time without delay.
Each resident's property shall at all times be properly maintained in
good condition/repair, including but not limited to:
• Resident home and
structure must be properly repaired and maintained at all times.
• Residents must seek
approval from the Architectural Review Committee before painting their
home if the color is to be changed.
• All roofs must be
kept clean and free of debris.
• Projection devices,
except chimneys or vent stacks, are not permitted.
• TV and radio antennas
and electronic devices of any type are not permitted unless approved
by the Architectural Review Committee.
• Sheds, tents,
temporary buildings or containers are not permitted. Structures
(sheds, crates, dog houses, portable on demand storage (a.k.a. PODS,
etc.) shall not be left on residents property.
• No lumber, brick,
stone, block, concrete, scaffolding, or other building materials used
for building and repair purposes, shall be stored on a resident's
property for longer than the length of time to complete construction.
• Residents shall not
build, improve, or alter a structure unless approval has been granted
by the Architectural Review Committee.
20. Mechanical Equipment
and Screening
No window air
conditioners are permitted without approval of Architectural Review
Committee. All tanks, pumps, condensers, heating and Air Conditioning
(AC) equipment must be suitably screened by landscaping or other
materials as approved by the Architectural Review Committee.
21. Marina
All residents of
Andalucia and their invited guests are allowed to walk and/or fish from
the main boardwalk of the marina. However, only AYC members are allowed
on the boat slip boardwalks A, B, C & D.
No cars, trucks, motor
homes, motorcycles, jet skis or trailers of any type shall routinely
park at the Marina for purposes other than using this property as
parking while at the marina. No overnight parking unless approved by the
President of the Board of Directors or his or her designee.
22. Motorized Scooters
In order to maintain a
safe environment for our residents, our children, and their invitees,
the following rules are established: - Anyone driving a motorized
vehicle that requires licensing by the State of Florida on the roads
within Andalucia must have a current driver's license recognized by the
State of Florida. - Only vehicles that are properly equipped and
licensed to operate on the public roads will be operated in Andalucia. -
Motorized scooters and similar vehicles may be driven on the roads in
Andalucia by licensed drivers, if the vehicle is licensed to operate on
public streets and has a muffler and does not create a nuisance or
safety hazard to the property owners, guests, and their invitees. In
addition to the above, please note that the posted speed limit within
Andalucia is 20 mph.
23. Parking
In order to maintain the
community's aesthetic standards, keep the streets safe, and not to
adversely impact the quality of life or property owners vehicle parking
is regulated as follows:
• Automobiles should be
parked in the residents garage whenever possible. Automobiles may
temporarily be parked in the street provided the vehicle is not
blocking traffic.
• No trailer, truck,
pick-up truck, boat or motor homes of any kind shall be parked
overnight on any Lot, on any driveway, or on any street without the
express written consent of the Board of Directors or unless located
within a fully enclosed structure in a building located thereon and
shielded from view.
• Passenger automobiles
and vans, may be parked overnight in a driveway. Passenger automobiles
and vans shall not be parked overnight on any street without the
express written consent of the Board of Directors.
• Recreational vehicles
such as motor homes, RV's, camping trailers, boats and/or boat
trailers should only be parked in Andalucia for the purpose of
loading/unloading and minor maintenance. Such parking is permitted for
a maximum of 24 hours unless approved by the President of the Board of
Directors or his or her designee.
• No vehicle which is
not currently licensed or cannot operate on its own power shall remain
upon any Lot, or anywhere within the subdivision, unless parked inside
a garage.
• No vehicles of any
type shall be routinely park on vacant lots or common property unless
designated as approved parking areas for the type vehicle being
parked.
• Construction
equipment and vehicles may temporarily be parked on lots where
construction is underway or adjacent vacant lots if resident gives
permission in writing. The resident who contracts with the owners of
such construction equipment/vehicles is responsible for any damages
incurred as a result of such vehicles parking on adjacent lots or any
damage to association common property.
• No Vehicle of any
type shall routinely park at the Jetty, Marina, Clubhouse or Pavilion
for purposes other than using these community properties. No overnight
parking unless approved by the President of the Board of Directors or
his or her designee.
• Resident motor
vehicles, or those of their guests, invitees, or licensees, shall not
block any sidewalk. Visitors traveling in a self-propelled
recreational vehicle or with a trailer will store such vehicles in an
approved storage area designated common property which may be
available, for a period not to exceed seven (7) days, unless any
additional period is approved by the Board of Directors or their
designee.
• Such vehicles shall
not be lived in during the course of the visitation period.
• Service vehicles may
be temporarily parked in designated parking areas during the time they
are actually servicing improvements upon a residence. No overnight
parking except in the case of an emergency.
• No parking is allowed
on streets within the subdivision except as specifically permitted by
the Board of Directors.
• Residents are
responsible for ensuring their guest, visitors, and invitees follow
these parking regulations.
24. Pavilion
No Vehicle of any type
shall routinely park at the Pavilion for purposes other than using this
community property. No overnight parking unless approved by the
President of the Board of Directors or his or her designee.
25. Pets
Residents may keep dogs,
cats and birds as household pets provided they are not bred or raised
for commercial purposes. Pets shall not be permitted to be on the
property of others without the expressed and previously given permission
of the property owner. Dogs must be kept on a leash within Andalucia
when not on the residents enclosed lot. Residents must follow the rules
and regulations set forth by the Hillsborough County Animal Services

26. Ponds
The ponds are for
residents and invited guests only. No boat over 12ft or any mechanically
powered by combustion engines boat's are permitted. No docks or similar
structures are permitted unless approved by the Architectural Review
Committee.
27. Prospective Buyers
Prospective buyer will be
issued a real estate packet at the Andalucia Guard House when inquiring
about properties within the community. Note: Packets are not available
for realtors. The packet consists of a general welcome letter including
basic information about Andalucia, a map of the community and all
current properties available, which are provided by the listing
realtors. Prospective buyers must contact a real estate agent to
schedule an appointment for viewing and can not enter the Andalucia
community unless accompanied by an agent.
28. Realtors
Residents with property
for sale should inform their realtor that Andalucia offers a real estate
packet for prospective buyers. As properties become available within the
community for purchase, the residents listing agent or the resident will
be responsible for providing 50 listing sheets to the Andalucia Gate
House.

A realtor "open house" is
permitted 7 days a week between the hours of 10:00am to 4:00 PM. Open
Houses are not permitted on Holidays or federally observed days off for
holidays. The realtor is responsible for alerting the guard in
attendance and is required to provide the street address and hours of
operation. Prospective buyers are allowed at the open house only and
should leave the premise immediately after. Open House signs are allowed
but only outside the gates of Andalucia Resident who sell their property
directly, must abide by the same rules as realtors.
29. Rubbish/Trash
• No debris or
materials of any kind shall be placed or permitted to accumulate on a
Resident's property within Andalucia.
• Trash cans and yard
debris may be set out for a reasonable period to time (no more than 36
hours ) before scheduled trash pickup.
• Trash and yard waste
pickup in Andalucia is Wednesday.
• Trash and recycle
waste pickup in Andalucia is Saturday.
• Holidays may affect
pickup dates, so please check with Liberty Waste Management.
30. Signs
"For Sale" signs are not
permitted. Andalucia does permit a residents who is selling their home,
to place a special "Andalucia" sign approved by the Architectural Review
Committee. Please check with your realtor or the Architectural Review
Committee for detailed information. No other signs of any kind are
permitted unless approved by the Architectural Review Committee.
"Open House" signs are
not permitted.
Business or commercial
signs are not permitted within Andalucia. Residents shall not use their
property or the Andalucia community in any way directly or indirectly
for business or commercial use when such use is observable from
residents and guests. Business or commercial signs placed on vehicles
are not permitted unless the vehicle is parked in the resident's garage.
31. Soliciting
Soliciting is strictly
prohibited. Any resident who wishes to solicit inside Andalucia must
seek the approval of the President of the Board of Directors or his or
her designee.
32. Speed Limit
The maximum speed limit
in Andalucia is 20 MPH. Residents will be held responsible for their
invitees (guests, contractors, etc.) who violate the speed limit.
Failure to comply will result in fines for non-compliance.
33. Structural Additions
No improvements or
changes to a residence structure can be made without approved by the
Architectural Review Committee. All exterior changes including but not
limited to: exterior lighting, fences, flag poles, swing sets, must be
approved by the Architectural Review Committee prior to implementation.
34. Swimming Pools
Lanai Swimming Pools
shall not be nearer than ten feet from any lot or easement. The pool and
lanai plans must be approved by the Architectural Review Committee prior
to construction. The pool and lanai must be located to the rear of the
structure unless otherwise approved by the Architectural Review
Committee.
35. Vandalism
All thefts, loss of
property, vandalism, suspicious persons/activities, and other
security-related incidents should be reported to the Andalucia Gatehouse
immediately at 645-5032. An investigation will be conducted and security
report filed. Any resident or guest involved in the intentional damage,
tampering with, or theft of Andalucia property, or the personal property
of any resident, will be subject to payment or restitution, and may be
subject to prosecution under state law. Please note that on-site
security will serve as a deterrent to persons intent on committing
criminal acts within Andalucia. Fox will be patrolling Andalucia more
frequently but we need each and every resident to be more aware of what
is going on in our community and speak out. The Board asks that each and
every resident be aware of what is going on in Andalucia in terms of
strangers, suspicious activity, minors drinking, etc. and report these
activities to the Gatehouse.
36. Vehicles Operated in
Andalucia
In order to maintain a
safe environment for our residents, our children, and their invitees,
the following rules are established:

motorized vehicle that requires licensing by the State of Florida on
the roads within Andalucia must have a current driver's license
recognized by the State of Florida.
• Only vehicles that

be operated within Andalucia.
• Motorized scooters
and similar vehicles may be driven on the roads in Andalucia by
licensed drivers, if the vehicle is licensed to operate on public
streets and has a muffler and does not create a nuisance or safety
hazard to the property owners, guest, and their invitees.
• Construction
and maintenance equipment may be driven on the roads, but only when
used directly for the purpose of construction or maintenance
activities. Such equipment, including riding lawn mowers, tractors,
etc. may not be driven on the roads or common property by minors (age
15 or younger) or persons without a driver's license recognized by the
State of Florida.
• Motor vehicles are
not permitted to be driven or parked on vacant lots or Master
Association common property except to park where and when parking is
permitted by the Board of Directors.
